He is married to Nikki Butler, a fashion designer he met at a screening of In the Soup at the Sundance film festival. They were married on January 25, 1993 in Belize while Tim was working on Heart of Darkness. She likes 19th century costumes and was the inspiration for his Rob Roy character.

They have two children, a son named T. Hunter Roth (the "T." standing for Timothy and the Hunter after Hunter S. Thompson and Hunter Carson) who is about four years old and a three-year old son, M. (Michael) Cormac. Tim also has a son named Jack who is about 18 years of age. Jack lives in England with his mother, Lori Baker.

He lived in London while working on his film, The War Zone, but he usually lives in the Silverlake district of Los Angeles because "it's cheaper there." He has often mentioned a possible move to New York.
